The Appeal Court yesterday upheld a three-year prison sentence and an 8 million riel (about $2,000) fine handed down to the former director of the Preah Vihear tax office who was found to have absconded with about $9,000 in state funds.</div>

Several hundred ethnic Kuoy villagers in a land dispute with a Chinese sugarcane plantation in Preah Vihear province have seized a pair of the firm’s bulldozers that were being used to clear their farms and are holding the two drivers hostage.</div>

Roeung Khan, one of the villagers, said Tuesday that about 400 people surrounded the bulldozers on Monday afternoon, confiscating the machinery and detaining the drivers, who had been clearing land the Kuoy say they have been farming for decades. The Lan Feng company was granted a concession for a plantation on the same land in Tbeng Meanchey district in 2011.<span id="more-75062"></span></div>

“We saw more than 10 bulldozers clearing the land, so we confiscated two of them and arrested the drivers while the other bulldozers drove away to escape,” Ms. Khan said.</div>

Ms. Khan said about half of the villagers were staying on the disputed land to prevent the company from returning, while the rest had pushed the two bulldozers they seized—the other drivers made off with the keys—to the local commune office with their operators in tow.</div>

She said the villagers had taken complaints about the company to authorities many times before, but to no avail.</div>

“We will return the bulldozers and drivers to the company if they sign an agreement with us and with the authorities to stop clearing the villagers’ rotational farmland,” she said.</div>

Nem Thaing, the chief of Brameru commune, said he would send the bulldozers and drivers on to the district office today and accused the firm of violating the villagers’ land rights.</div>

“I think that taking the two drivers was right, because the villagers have talked to the company representatives many times but they do not listen to them,” he said. “I think the company is in the wrong because the villagers have been cultivating their farms for a long time.</div>

“This is not a small case because the company is not following the law,” he added.</div>

Mr. Thaing said the villagers had been farming the land since the fall of the Khmer Rouge in 1979 and that Lan Feng was only granted its 9,000-hectare concession in 2011.</div>

Even if families do not have titles to their land—which the Kuoy do not—the country’s Land Law gives them rights to the area if they can prove they have been living there since 1996.</div>

Lor Chan, provincial coordinator for rights group Adhoc, said he had seen the villagers holding the bulldozers and drivers hostage.</div>

“The villagers have filed complaints with district and provincial officials accusing the company of clearing their farms illegally, but [the officials] have never solved the problem,” he said.</div>

District governor Ung Vuthy, however, said authorities have tried to resolve the dispute by agreeing to carve some land out of the plantation for the villagers—in accordance with what the government calls its “tiger skin” policy—and accused the villagers of asking for too much.</div>

“We have told the villagers that we will cut out the disputed land like a tiger skin, but they want the company to leave the area. We can’t grant their request because the company has received the land concession from the government,” he said.</div>

Mr. Vuthy said he has urged Lan Feng to stop clearing the land until the dispute is settled, but also vowed to return the bulldozers and drivers to the company if and when they arrive at his office.</div>

On Monday afternoon, the villagers surrounded two bulldozers belonging to the Lan Feng company—which in 2011 was granted a roughly 9,000-hectare concession on land the minority community says it has been farming for generations—that were being used to clear rice fields. They then pushed the machines to the Brameru commune office and held their operators overnight in the forest.</div>

Wednesday’s meeting at the commune office—where the bulldozers are still being held by sympathetic commune officials—was organized after provincial agriculture department officials released the drivers back to the company Tuesday evening, despite taking them off the villagers’ hands with the promise of keeping them in custody, according to Nuon Mon, a representative of the villagers.</div>

“Provincial agriculture and court officials came to meet us at the commune office last night and they took the two drivers to keep them safe and promised they would not get loose,” Ms. Mon said.</div>

Tinh Trida, director of the agriculture department, said he had no choice but to release the drivers, as their detention had been unlawful in the first place.</div>

“We allowed the drivers to return to the company office…because we know this was illegal human detention,” he said.</div>

Ms. Mon said that with the drivers free and Wednesday’s meeting a bust, the villagers’ next move would be to push the bulldozers to the Preah Vihear Provincial Court in the provincial capital, where they could be used as evidence against the company.</div>

“We will prepare a complaint to file with the court,” she added.</div>

Chang Sieumey, a translator for Lan Feng, said the Kuoy villagers have long claimed the contested land as their own, but have never produced any documents proving ownership.</div>

“The company will not clear the land if those villagers have legal documents, but we have never seen any,” Mr. Sieumey said.</div>

“We are now cooperating with authorities…to solve the problem,” she added. “We will continue to clear the land for planting sugar if authorities decide that the land belongs to the company.”</div>

After villagers in Preah Vihear’s Brame commune briefly held two drivers hostage and confiscated bulldozers on Monday due to an ongoing land dispute, two Chinese concessionaire companies and provincial authorities agreed yesterday to temporarily cease the clearing of contested land in the area.</div>

During a meeting with the Chinese firms and authorities yesterday, 200 community members demanded Rui Feng International and Lan Feng halt the three-year clearing project on their lands as it greatly reduces the standard of living of the 367 families, many of whom are ethnic Kuoy minorities.</div>

The decision was several days after Brame community members briefly kidnapped two company drivers and confiscated bulldozers on Monday to bolster their opposition. The drivers were subsequently released and the machinery returned to the companies the following day.</div>

Separately, in Mondulkiri, about 100 Phnong ethnic minorities in Keo Seima district yesterday seized a bulldozer owned by Vietnamese company Boeun Peouk in protest of land clearing in the area.</div>

According to villagers, Boeun Peouk has destroyed crops while clearing land in the district and their pleas for discontinuation have fallen on deaf ears.</div>

The Thai side of the An Ses border checkpoint—which Thailand closed late last month in response to roadwork on the Cambodian side in Preah Vihear province—will reopen Friday, following a meeting of Cambodian and Thai officials Thursday, officials said.</div>

The meeting was held between Preah Vihear provincial governor Oum Mara and Serm Chainarong, the governor of Thailand’s adjacent Ubon Ratchathani province, as well as military representatives from both sides, said Nuon Nov, the deputy commander of the Royal Cambodian Armed Forces’ Division 4, who also attended the talks.<span id="more-75708"></span></div>

Mr. Nov said the meeting centered on the road construction and that Thailand had agreed to reopen the border at 9 a.m. Friday.</div>

“Thailand said that in the future, if we want to pave the road on our side, we need to send a message to Thailand first,” he said, adding that Cambodian officials agreed to do so.</div>

On December 28, Thai soldiers approached the road crews and ordered them to stop work because they were in a disputed area and in violation of a memorandum of understanding to not develop the area, Choam Ksan district governor Chea Kimseng said at the time.</div>

When the roadwork continued, Thai soldiers closed the Thai side of the border as some 200 additional troops reinforced the area, according to Mr. Kimseng.</div>

Mr. Kimseng said Thursday that officials at the meeting decided to reopen the checkpoint because it would benefit communities on both sides.</div>

Preah Vihear province, which borders Thailand and Laos to the north, is home to three of the most captivating temples of the Angkorian era: the Preah Vihear temple, the Koh Ker temple, and the Preah Khan Kampong Svay temple. It also houses communities of many ethnic hill tribes.<br />
Koh Ker used to be a capital of the Khmer Emperor King Jayavarman IV who built this city in the year 921AD. Some parts of the temples are still hidden in the jungle and are not accessible. The Preah Vihear temple is most significant in this province.<br />
The temple of Preah Vihear, dedicated to Shiva, is situated on the edge of a plateau that dominates the plain of Cambodia. The temple is composed of a series of sanctuaries linked by a system of pavements and staircases over an 800 metre long axis and dates back to the first half of the 11th century AD. Nevertheless, its complex history can be traced to the 9th century, when the hermitage was founded. This site is particularly well preserved, mainly due to its remote location. It is exceptional for the quality of its architecture, which is adapted to the natural environment and the religious function of the temple, as well as for the exceptional quality of its carved stone ornamentation.<br />
A unique architectural complex of a series of sanctuaries linked by a system of pavements and staircases on an 800 metre long axis, this temple is an outstanding masterpiece of Khmer architecture, in terms of plan, decoration and relationship to the spectacular landscape environment.<br />
Preah Khan Kampong Svay, also known as Prasat Bakan, is a complex of gigantic proportions located in the southwest corner of Preah Vihear province. It covers an area 4 times that of the Angkor Wat with a 3 km long Baray and a large number of towers or Prasats within the compound. Largely unknown and rarely visited, the temple had been very badly looted over the years.<br />
